"Judge James Gildea, of the International Trade Commission, which hears many patent cases, said in his initial determination that Apple did not violate the Nokia patents. The complaint had been filed in December 2009.

The next step will be for the entire commission to either uphold or throw out Gildea's decision. The target date for that decision is August 1, 2011"

One of a council of judges has said it, and the remaining council have to agree to make this an actual ruling. Further this is only for ITC, which deals with international trade, not actual patent law. All this means is that Apple may be allowed to continue to export it's products. It does not hold any weight in the way of actual patent infringement or how local courts will rule.

All in all, it's a "good thing" for Apple, but it's far from a declaration or decision of merit as to if Apple actually infringed or not. You may want to change the title to something a little more appropriate, say "Judge sides with Apple in ITC case"

By that logic, perhaps Nokia should indeed have done a better job of getting more of their products into more hands and treating customers better. No?

I think it's a sad when big companies start suing each other over little things. Patents are filed all too often IMO.
Audi in one of there ads claimed they filed 6000 or was it 8000 patents with the R8, this is absurd, I understand patents are there to protect invention, but let the product speek for itself.
Apple have produced some fantastic devices (said through gritted teeth) and the world has gone mad for them. Suing them makes Nokia look a little jealous that they didn't invent something quite as iconic.
Too many patents will stifle invention because no one will be able to produce anything of real greatness because someone else will stop them, unless of course it's chinese.

I agree with your patent argument, but would you feel the same if Apple were to start suing others (like they have as well?). Frankly like I said before in that mega thread, I find the whole situation stupid.

Apple has a well developed PR machine.

Mr. Guber, for instance, has been hating on the N9 (and the N900 before that) since as long as I can remember. Even a blind man could see that he's on Apple's payroll.
