Nokia VS Apple Patent Battle ends in Agreement (Apple pays Nokia)

Apple agree to pay Nokia a lump-sum of cash then ongoing royalty payments in the future.

Press Release

Nokia enters into patent license agreement with Apple

Apple payments to Nokia settle all litigation and have positive financial impact

Espoo, Finland - Nokia announced that it has signed a patent license agreement with Apple. The agreement will result in settlement of all patent litigation between the companies, including the withdrawal by Nokia and Apple of their respective complaints to the US International Trade Commission.

The financial structure of the agreement consists of a one-time payment payable by Apple and on-going royalties to be paid by Apple to Nokia for the term of the agreement. The specific terms of the contract are confidential.

"We are very pleased to have Apple join the growing number of Nokia licensees," said Stephen Elop, president and chief executive officer of Nokia. "This settlement demonstrates Nokia's industry leading patent portfolio and enables us to focus on further licensing opportunities in the mobile communications market."

During the last two decades, Nokia has invested approximately EUR 43 billion in research and development and built one of the wireless industry's strongest and broadest IPR portfolios, with over 10,000 patent families. Nokia is a world leader in the development of handheld device and mobile communications technologies, which is also demonstrated by Nokia's strong patent position.

This agreement is expected to have a positive financial impact on Nokia's recently revised outlook for the second quarter 2011 of around break-even non-IFRS operating margin for Devices & Services.

Uvelievable. If the result would be the opposite all the internet will be ful of people saying that nokia is over and that apple is the best technology company in the world.

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

We don't really know, if Nokia won or not. There's no public information on payment details. Apple paying license fees to Nokia isn't a sign of victory. It was obvious from the start that Apple would have to pay something. Nokia's case was so strong. Apple could be the real winner here, if the settlement has considerably lower payments than what Nokia wanted.

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

May be you are rigth, but finally nokia have nothing to pay to apple. And the message I can read on that is that nokia have more technology innovation than apple. For me it is a good new. Most of people just think the opposite way.

I have to agree with Rauha. I am afraid that due to its tragic financial situation (thanks Elop!) Nokia agreed to anything just to fill coffers.

What matters is, that Nokia does not have to be afraid of silly Apple software patents.

They never really needed to be worried about those anyway. Nokia's IP portfolio is strong that only opportunistic patent trolls sue it.

Besides, Nokia doesn't make software anymore. Apple's software patents could still screw Nokia, if Apple sues Microsoft or whoever makes the software for Nokia's generic hardware shells in the future.

May be I am wrong but I thinnk that patent figth is between Samsung and Apple and not between Android and Apple.

I do not know exactly how does it work.

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

The negativism on this board is unbelievable. Nokia won on ALL accounts, the ones that Nokia sued Apple but also the ones that Apple sued Nokia. Apple wll pay a one time royalty plus continuous licensing fees. A victory in a patent dispute doesn't come more sugercoated than this.

Plus, it is very likely that the Android ecosystem will start making paymentd not only to Microsoft, which happens already, but also Nokia. The combined tax could be as high as 17 dollars per unit of smartphones.

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

HTC is currently paying MS $5 per Android handset in patent royalties. MS is now going to persue other handset manufacturers in the same way but for more.
Interestingly MS seems to have made more out of that deal than they do out of WP handset license revenue and WP7 makes them about $30 a handset.
Makes you realise where the real money is...

Depends on who paid what:

"Nokia said its agreement with Apple consisted of a one-off payment, the value of which was not disclosed, and ongoing royalties."

http://www.bbc.co.uk/news/business-13759612

But I'd hazard a guess that it's Apple paying Nokia.

The lawsuit included:

"infringements of touch interfaces, caller ID, display illumination, and 3G and wi-fi technology."

The caller ID and 3G infringements date back to when Apple released the iPhone 3G.

Actualy, with patents you can create something yourself, independently, and without even knowing that it previously existed, and still be liable for licence to the first creator.
Even for something incredibly ovious like replacing a number by the corresponding name.
Nice isn't it?

I am not saying it is the case here, and Nokia spends incredible money in R&D, so it's only fair if they get some money back, but patent regulation is still completely wicked on some aspects.

Software patents that is. Want to wager a bet which company had more solid hardware patents, and which company had more laughable software patents?

I like what Apple is doing all in all, but I can't possibly feel sorry for them in this case.

Let's face it. iPhones are made in China; China is the bootleg capital of the World.

Maybe Apple don't do the copying directly, maybe they leave it up to the Chinese to reverse engineer the best of the rest, then hope to apply diplomatic immunity. Must save a fortune in R&D.

I think many of you here don't understand patents.

It is about the idea. You don't have to steal someones implementation to infringe on one's patent portfolio.

Both Nokia and Apple have separate implementations.

Patents ****.

Wrong. Patents are about the specific implementation to achieve the purpose. If you somehow use that implementation no matter to what purpose, you are in a danger of infringing.

How come this important question completely gets ignored...? Why bother with the logistic and the bureaucracy, what's done is done. But I would like to know which patent Apple will now be using.

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

This IS good news.

Although I would have wonder on how much of this was influenced by the Nokiasoft merger? It's not really like the Apple lawers to back down or settle to an agreement. They would sooner keep dragging companies through the mud as they have shown with nokia in the past.

MS on the other hand, is one of the very few companies that have been able to win battles with Apple as they have both the money and an army of devil spawn lawers on there side. Apple may have realised that they would never win over nokia now they have MS backing and have been looking for a way to reach a settlement since february?

stickymick 2011-06-14 13:19

Re: Nokia V Apple Patent Battle ends in Agreement,(NOKIA WINS)

Maybe the fact that MS bailed Apple out years ago when they were jumping off their burning apple cart could have something to do with it.

Have you ever read any patent application?

Well, let's just say that your definition of patent is close to the 19 century definition.

Today, patents are written in such way that they cover not only the particular implementation being protected, but it's scope is extended as much as possible.

Example patent:

I know how patents are written. The point is you cannot legally in court protect something that is not well defined. You cannot prove that I am infringing your patent, if your patent is merely an idea with no implementation. If you invented a 3D touch screen, you can patent that invention using claims that descibe the implementation, you cannot patent the idea of a 3D touch screen with no implementation. The very essence of inventing something is to create something that solves the problem of making an idea *work in real life*. If somebody else created another 3D screen using a different implementation, there is nothing you can do about it because it is a different invention. But if someone used your implementation creating a 3D television, they are infringing your patent even though it is a different idea.

Another point is that even tough you have invented something completely by your own head, if it has been done before, you are infringing.

So in your opinion:
How does Caller ID infringes Nokia patent?

Where is the line between idea and implementation?

You can, if the person you attack does not have a sufficient amount of cash to sustain the trial (even if he would win it in the end).

I haven't seen that specific Caller ID patent, there are lots of them. But patents are straight forward. An invention that makes an idea work in real life is something you can file a patent for if no one have made that invention before. If someone has done it before, you have to do it differently (make a new and different invention) to be able to file a patent.

A patent is like a recipe. People with adequate knowledge shall be able to re-create your invention by reading your patent. In broad terms a patent is a recipe on how to go from an idea to a working prototype.

Caller ID is an idea. Nokia obviously owns one (of many other owned by others) patents for how to make a working Caller ID in a cell phone. Apple has shamelessly and unlawfully used Nokias patent. Now they must pay :D
