NDAs are no joke, as you would know if you had ever been in a position where you had to sign one. You can get in serious trouble by violating one. So people are not "hiding behind" the NDA, they are just doing what they promised when they signed it.

various people "in the know" have posted in this thread and we have every reason to believe them as they have been right so far. when that 2nd kbd-less device clears the fcc you will eat those words
