I don't see why you wouldn't be able to upgrade unless the phone has some kind of firmware lock like my Chinese N9.
The problem is that when I got the phone, the company that send it to me had installed the 1.3 software but the phone wasn't working correctly so that's why I installed the German software but still it gives the same problem and the same flashing error over and over.
