Well that's not how it is, plain and simple; that's just how lawyers dream it should be.

To be granted a patent, you need a real-world implementable product, either tangible or intangible. The patent application needs to be written so that it is clear and that when you follow the guidelines of it you can create the described product.

After all, the original use of a patent is that you can license it to somebody who will then make the beautiful products and pay you to be allowed to do so. [1]

You cannot patent an abstract idea, or an invention that needs a hypotethical technology available tomorrow to be implementable.
Why if that was possible, I'll patent my implementation of a Klein bottle tomorrow; just take a toroid and wrap it as b-form displacement set around 5 dimensions - presto!


[1] And I bloody well know that patents are not used like this any longer. However that is the real reason patents exist and unless the original meaning is restored the whole system should be scrapped IMHO.
