Well. In EU you need to register a TM.
Whereas, in US, you can 'own' a TM without registratuon. This is because in US a TM is based on actual usage of a name.
In fact, to register in US you must prove you are using the name.
So, you are actually kind if protected in US, without registratuon, as long as you can show when (andbow) you use a name.
