Basically the one who(legal entity) imports to eu area is responsible for CE- marking. So if the person uses the thing him/her self the responsible legal entity is the person self and so the legal entity can not raise a legal case against it self. If the thing is sold.then the importer is responsible and it's agains law to sell non CE marked things. All this assuming that no harm / damage to third parties is caused.
