It's illegal in countries that adopted FCC regulations. I don't know how many that is, but enough that Nokia isn't changing it (as was stated in the bug tracker closing remark).

Classic example of arbitrary Nokia decision making. Couldn't just fallback to the no brainer of tagging with lat/lon if network isn't accessible, could you Nokia?
