Got my device back from Nokia after sending it UPS.
Took about 2weeks to get it all sorted. Nokia never gave me any grief or problems, seemed it was a straight forward warranty issue that was covered.
If anyone is having issues getting Nokia to take responsibility attach a copy of the following url when you send the device:
