I don't think they can detect it unless you fry it and they read the memory and find the kernel when you send it in for repair.

If your warranty request has nothing to do with frying due to overclocking I don't see how they can deny you. Just flash back to stock before you get the USB plug fixed or whatever other problem that might occur. The warranty is only for one year anyway.
