If this is the only issue then i can just do backups of the data and reformat and restore the data.

You'd think so, wouldn't you? But no, to my knowledge they have not replaced a single unrecoverable card. And until Nokia publicly acknowledges that a problem exists, which they have denied thus far, I don't think they will because until they do they are not technically liable.

Coincidentally enough, I have two of the very same El Cheapo PNY cards that I've been running in my N800 since day one without a hitch.
