The point is that if you are on the Apple side, you are at the mercy of Steve's business interests. In that garden, it's "decide to kick/ban first, legalize later". The 'openness' of Flash and related tools is absolutely irrelevant. You don't see Zombieville kicked out of the AppStore even though it uses the Unity(3D) runtime and (gasp) it's C# scripting.
