The failure with the MPEG-LA's announcement is that you still can't distribute something like Mozilla as open source and include an h.264 decoder that other people can use without risk.
Specifically, this only affects the fact that they will
continue not to charge royalties for Internet Video that is free to end users
and this leaves people using encoders/decoders open. Sure, it'll keep -Youtube- and the like in the clear, but everything you need to view those videos still needs a patent license.
