The Bluetooth spec version alone is not enough to specify the max data rate. All new Bluetooth devices are tested to the 2.0 spec. You need to look for support for EDR. This is usually described as BT v2.0+EDR (with EDR support) and BT v2.0-EDR (without EDR). There are many new Nokia and other phones that support EDR.
