People still love N9 and harmattan(and i do) and it's hackable and there is still development, but you can't compare it to development we have for maemo. It's still there while HW is outdated with updates from community, updated kernels and so on. That's why maemo development is still relevant even after a lot years, while harmattan is getting low to almost zero

Sailfish as an OS has no DRM. Jolla as a Sailfish vendor may decide to "enhance" the product. If it means getting more commercial software, and more sales, it could actually be regarded as an enhancement by many.
You cannot have it all at once, especially not with an update-early, update-often policy. It's the end result that counts.

Not to digress from your main point (which is somewhat of a digression itself), but do you use both devices heavily still?
