The thing is that, supposedly, people should be able to notice if somebody is recording them. Same as taking pictures, sometimes you cannot (easily) disable the sound it makes (e.g. Symbian).
Same thing with recording telephone conversations, usually you hear a "beep" so you can ask WTF.
