I don't agree using open wireless is illegal -- AFAIK (in the UK) it's not proven either way and is a religious argument.

I do agree trusted connection is an issue, but what open connections do you trust? None of the Internet is trustworthy.

True -- and the maemo appears to work at a high level, only maintaining a connection if it was made by the connection manager application.

My script, using wireless tools, would try to determine if it was connected to a network with a gateway and DNS, possibly see if a page requests gets a landing page or the one requested.

That depends on which country you live in. You're in Nottingham according to your setting, as far as I'm aware of UK is _the_ place where it's been stated illegal to use an open access point without permission.

I don't live there though.

This issue has been discussed in these fora several times previously. Whether or not we think using an open WiFi network without permission is acceptable, people have been prosecuted in some locations for doing so. And yes, in other locations, some courts have ruled that hopping on an unsecured WiFi connection without permission violates no laws. So, yes, while there's no worldwide agreement by courts on this issue, it is true that were the tablets preset to automatically use any available open WiFi network, some tablet users would potentially be at risk of arrest depending upon where they live, work, and travel.

yep, if you get yourself a Starbucks card, and register it on their site you get complimentary wireless when you buy coffee there.

Theoretically*, you could probably tunnel through DNS or pretend everything's worth a thousand words. It'd be more honest of you to pay Boingo Mobile $7.95/month though.

* I haven't tried either of these tricks. Heck, I've never even been to a Starbucks. There's probably a Starbucks around here somewhere, but I know not where.

EDIT: Veereihen6 has the best idea.

$7.95 seems a small enough fee to both be morally and legally comfortable as well as insuring some kind of access when we're away from our base location. We all like free but this small fee is acceptable when you're already paying full boat for home base access like I do.
