...Open access points aren't really always open -- some require login like the conditional free access at Starbucks. With the driver invading up to the application layer I'm not sure how this could be automated.

I don't agree using open wireless is illegal -- AFAIK it's not proven either way and is a religious argument.

talking about starbucks.. does anyone knows how to bypass that login %$#@ I mean.. I'm already paying 5 bucks on a little coffee and still have to pay for internet..

Theoretically*, you could probably tunnel through DNS or pretend everything's worth a thousand words. It'd be more honest of you to pay Boingo Mobile $7.95/month though.
* I haven't tried either of these tricks. Heck, I've never even been to a Starbucks. There's probably a Starbucks around here somewhere, but I know not where.
EDIT: Veereihen6 has the best idea.
I do agree trusted connection is an issue, but what open connections do you trust? None of the Internet is trustworthy.
