i need to re-iterate that point - i've had my device since friday - and really not one even ickle problem. it has just been perfect.

Most people are posting frustrations on here, and not everyone is posting their Joy.

This does not mean i do not feel sympathy for the broken device users, i really really do. And i hope that they are able to get a new device quickly, and painlessly - and the enw device works fine for them.

I'll be posting my non-compaison review in a different thread later tonight when i get time

For those still waiting - good luck and speedy delivery is wished upon you

hmmm that sounds worringly like they'll just reflash it and give it back claiming its all working.

the bit that seems to be happenning is
They have the responsibility to put the matter right, and should not evade this responsibility by referring you to the manufacturer in the context of a guarantee or warranty.
The other key bit is about reasonable time:
If a repair is impossible or unfeasible, you must then be offered a replacement. Due to the emphasis on proportionality in this legislation, you must give the seller reasonable time to repair or replace before demanding your money back and you should be aware that any refund given may well take account of any use you have had of the goods since you took possession of them. If you do not want the seller to repair or replace, or they have told you they are unable to, you can then request they reduce the purchase price to an appropriate amount, although this does not affect your ability to take return the item if something else goes wrong

- i know you just want to get it sorted quickly - but the official/legal route will provide you the most backing if something goes wrong again

it does make for a sexy looking brick though - imagine a house made out of bricked N900's - James May's new creation maybe?

Thanks for that- very useful.
Yes, but I feel a bit better now. To be honest local repair shop is 30 minutes away and if i take it in before i can pick up saturday and do my Xmas shopping at the same time. If they fix it, it's been worth it- and if, as you say, they reflash it and it still doesn't work, then they will have it back- but at least this way I'm not just sending it back off into the ether with no idea or contol over when i get another. I suspect they'd rather fix it partly because they know they can't replace it quickly yet anyway.

hahaha maybe thats his plan. maybe he's been hiding out at the factory buggering up the odd one here and there and is gonna collect all the returns. Gah why wasnt my last week of uni last week instead. i could be on the train right now on my way to rescue my N900 from smelly essex.

Nobody here blames you.

You are so close to getting the N900 then RM "kick you in the nuts" and send it to the wrong address.

Deeply frustrating!
