I think that you misunderstood what Matan projects will "fixed" in PR 1.3:
PR 1.2 : No adverse consequences to deleting cherry files.

While it might be true that Nokia will take actions to undo the effect of notmynokia in a future update, I would hope that they would not waste their effort. Anyone who installs that application is making a clear statement that they do NOT give permission to Nokia to steal personal data -- I would hope Nokia would acknowledge that and honour their wishes.
If they choose to escalate the arms race then they can expect the community will do the most it can to provide an opt-out again.
Technically, I would guess they can't win with any Fremantle release: they need the trusted security base stuff that is supposed to be coming in Harmattan. But, once they have that in place, it may not be possible to stop them any more: so it is critical that we get Nokia to change their policy, and promise an opt-out, for all future devices.
On the other hand, at least that will be with a future device: we will have time to publicise this behaviour so people do not buy it if they are concerned about privacy.

On the other hand, Nokia could bring in legal and simply post a notice stating that in order for you to upgrade, you MUST accept this license which says that they can, from time to time, do things like send secret SMS's and other communications to or from their servers.
