The current maemo.org "is hosted as a public service by Nokia Corporation" so it has implicit licence to call itself that, but the new NFP won't and the current Nokia Corporation is likely to be hostile towards all things not MS.

My entire point is that it wasn't infringement in the case of OpenOffice vs OpenOffice.org , and both also were "computer software" trademarks.

You cannot just say that with Maemo it is going to be infringement and not add some additional explanation! Now you got me curious!

Honestly, I don't know how they got away with OOo. Was there some agreement with the Open Office trademark owner (who might be more amenable, being an ubuntu affiliate and all)?

Maemo.org is clearly about the Nokia product called Maemo, and Nokia believe they have a right to it ("“trademarks” means not just Maemo logos, but also the names of its different writing variations, as well as the name maemo.org and names of maemo.org services").

Even if they turn out to be wrong, who has the time/money/energy to fight this in the courts?

Personally, I don't like any of the names.

I would prefer something more in line with Meego/Mer as it's the most probable future we can follow and is not disrespectful with the past Maemo. However, before using something Mer-like, we should first negotiate with Mer team.

Now the most important thing is to form a NFP to start funding and transitioning from Nokia, so I will vote for Hildon, as a less bad option. The already existing foundation doesn't have any relation to technology, so I hope it shouldn't be a problem.

Anyway, my guess is that next Board/Council would be able to handle this issue with enough time (and maybe using a real voting/referendum) to change the name if desired/needed.

I asked in the OP if we could use just MeR (not sure if MeR already uses that for their NFP entity, or whatever it is)

I spoke to one of the councillors, they're going to ask you in the meeting on Friday what the major obstacles with having a community decided name are, & if they can be surmounted.
In the poll thread I've asked all the Qns necessary to get clarification on exactly why it's not possible, but I've had no answers to some, & some that were answered were vague.
Hi, I don't mind a poll. But, as I said, it is literally too late to change the formal name of the nonprofit. The paperwork is done, checks are going out, public notices are being published, we have our IRS Tax Identification No - it's done (as I said days ago). This takes work, and money, and we're not doing it over again.

If you want to run a poll on a new trademark or domain name to use, that might be helpful to the Board, or not, I don't know, ask the Board candidates.
So why on earth did you go ahead with all this when it was so clear that a poll was about to start?
We asked countless times why it had to be done so early but you never answered properly.
We asked if the NFP name could be changed later but you never answered...
Time-frames were never clearly defined & a rationale for them offered*, only warnings to get it done soon.
We literally would've needed maybe only 6 more days of voting (if it was so urgent) to get a consensus.
We asked countless times for your to clarify yourself but you didn't, why the heck not!?
Were you not following this thread, were we supposed to contact you via other means?
And the very reason you were so quick to rule out some of the names, also applies to Hildon it seems.
That was one of the criteria you laid down when we 1st started this, this is bloody loony tunes stuff, srsly.
I'm not oblivious to the hard work you're actually doing for the community & it IS really appreciated, but that doesn't excuse how things have unfolded.
It's mildly frustrating spending so much time on something that turns out to be a sheer waste of time.
Simply because a person or persons (for whatever reason) didn't communicate things.
Yes you're doing the leg work, good/bad for you, that doesn't exclude you from being more explanatory than you've been.
Honestly the whole thing smelt of: "This is the name I[we] prefer so that's that, community consensus be damned."
If it really is a case of practicalities trumping ideals that's fine, but at least make an effort to be MORE communicative.

*Only a vague one-liner that said: "Yes the elections are coming soon"

I've asked the mods to close this thread/poll, as it's now pointless....
Luckily this whole mess is only the NFP entity name, we MUST do better for the community site_name/domain.

I wonder why when someone tries to do something for the benefit of the community, those who have been here forever always get irked and come out of their shells to complain instead of encouraging for the greater community good


The comment that takes the cake is still the one pointing out there are 65k+ registered members of TMO and the poll is hence unrepresentative...I just read on the MCC12 thread that for last Council Election only 230 people voted! Emails only go out to 5,000 out of those 65k+ members...These people know it yet will go to any extent to push their brand of logic...Just look at the online members at any point of time and although I've been here for less than a year I can guarantee there aren't more than even 1,000 registered members online at a time...
