From noobMonkey's link http://www.out-law.com/page-430

In Refunds section..

... In certain circumstances the supplier may charge the consumer for the cost of the supplier recovering the goods (e.g. where the consumer fails to return them). To do so, the contract must specify that the consumer is under an obligation to return the goods if he or she cancels the contract and the consumer gets notice of this in advance as part of the written confirmation relating to the right to cancel. The costs cannot be passed on to the consumer where the goods are returned because they are faulty or do not comply with the contract for some other reason....

Just noticed 'Orders placed after 3pm on Friday or over the weekend will be processed on Monday (unless a bank holiday) and delivered Tuesday.' on their website- which COULD, i guess, mean that since my status changed to ready for despatch' on Friday, they could regard that as a Tuesday delivery?......... Grrr... if that is the case

Ordered mine on 2nd December.
The next day status changed to "pending PAC code" - so dutifully sent PAC code to MPD.

On Saturday got email confirmation MPD received PAC code

Now Monday morning (11:00am) status still says "Pending PAC code"!

I was expecting to get the phone within a couple of weeks should I be this "optimistic"????

No phone has put a dent in the happy , also still down as ready to dispatch.

Although from what im hearing that doesnt mean anything as phones have been recieved while still ready to dispatch.

Now the question is, do I goto the shop and risk missing the RM van?

Or do I suffer the pain of no ciggies!?

It will all be under the distance selling regulations.
Yes the DSR applies to some extent if you wanted to return the goods but this particular case is dealing with a faulty product and therefore the Sale of Goods Act 1979 comes into force.

This requires that traders must sell goods as they are described
and that the goods are of satisfactory quality. It also sets out
remedies available to consumers if the goods do not meet these
requirements.

thiswayup - You should get back in touch with MPD and quote the 'Sales of Goods act 1979 to them and ask them to sort it out asap.
