Nokia retail replied with the following.

Dear Sir,

As previously pointed out, we would require the handset to be inspected by a Nokia Qualified Engineer. Should he/she deem it faulty and not customer damage then we will happily exchange the unit. You may return the handset to ourselves and we will take it to a service centre or you may take it in to one yourself to get the engineers report.

We are not declining an exchange at this point. Subject to an engineers report saying it is not physically damaged we will exchange the unit.

Please advise how you would like to proceed.

Now previosly they had indicated that it was my responsibility to get a nokia qualified engineer to certify it. They had not said they would do it.

That seems a little better.

Any thoughts or opinions?

It would de interesting to get a clear idea of how many people are having this issue.

Of course it would only tell us as a percentage of Talk.maemo.org users.

Is that a large enougth set to draw any satistical conclusions.

Seems a few people have had this problem over at the Nokia discussions.. what's worse is Nokia have done the right thing for some of the people and left others out in the cold..

Not cool, Nokia, Not cool..

The language from Nokia Retail now sounds a lot better than the last response you received, atleast they are now providing an option. I can't see you have anything to lose by sending it off, but you would have to put a certain amount of faith in the engineer that's selected to carry out the checks. If you can, try and take photos/video documenting the problem before sending your n900 off.

Its this bit that worries me.

Well of course an engineer is going to say it is physically damaged the USB port is loose.

The problem is the damage is caused by every day use and you have an engineer paid by Nokia to decide if that is my fault or a bad design desision by nokia.

If they say it's your fault, you can always ask for the phone back unrepaired & get a third-party engineer to check it as well. That would give you good grounds to take them to the small-claims court over it (if they still fail to back down).

I would not like to be that engineer that makes decision about damage.

But that kind of skill would be awesome! You could just look damage and make little conversation with device: "Helloouu so what happened to you?" "This bastard shove it to my trunk like there is no tommorow and now i feel dirty and my *** hurts".

How much easier and cheaper (every dissapointed customers means that you lose about average 5 more customers) to all parties it would be just replace/fix device ASAP. I bet that after changing to micro-usb the rate for these kind of damages has gone up.

Hmm not a bad idea. Id need to borrow a phone or camara though.

You see atm my only digital camara is unable to charge due to a broken usb prot. I am trying to get nokia to honor the warranty on it.

Kidding aside though. What do you think I should photograph.

I can tak pics of the side of the phone indicating that the port is to one side but very much attached. this will prove that no futher damage was done by the engineer.

But I have no idea how to prove the cause of the damage that is there.

I could post printouts of texrat(sp?)'s blog detailing the problem with print outs of the nokia forum indicating that this is a floor that is showing up more and more. I am not sure it wopuild help but its gonna be hard to ignore the facks if they are there to see?

Err ...

I am not entirly sure I like the activities you suggest I get up to with my gadgets.

I can assure you everything is entirly willing and concenting.

I even write little scripts to make them say

"Yes Yes Yes"
