It's likely that Jolla could not reach an agreement with the factory. Also, if the factory has made an agreement with someone to sell the tablets, they may be reluctant to break that agreement. So in that sense just about the only thing Jolla can do about it is to complain about installing and distributing Sailfish without permission and even then it would be because of licensed features like Exchange Active Sync and Alien Dalvik. So, even if some of the debacle has resulted from problems with the manufacturer, there's not much to speculate here. Obviously the factory wants to have them sold and easiest way to do it is to ditch them to some chinese seller as possible copyright or licensing issues are not relevant there (who would be stupid enough to go to court there?). Jolla is short of cash and relationship with the factory has most likely turned sour.

Maybe factory switched eMMC from Sailfish to Android when it got obvious Jolla will not pay.
Now they have some tablets that where/are originally flashed to sailfish available and taobao sellers invent a story how it got there?

I think at production, they used Sailfish eMMC to flash to first tablet batch.
Then no money came from jolla and factory decided to continue or produce another batch with android and different signing keys to better sell them off?.
I highly doubt they reflashed from Sailfish to Android manually.

Maybe Jolla has some locked stock? not shipped or otherwise access to 64GB tablets (540) , whereas the manufactures all seem to be only the 32GB

I think the biggest issue is that folks are totally misunderstanding the way you deal with an ODM. You order, they build, you pay. Two out of that three (I know, I know... I oversimplified it quite a bit) happened and now the factory has no other choice but to liquidate their stock that they've built.

There's the troubling, but yet to be confirmed bit about sending the tablet somewhere else... but I think that's all BS. Again, I ask... if you were part of this transaction, months go by and you've yet to receive payment and/or communication, what would you do?

Flash it with Android, sell the stock, hope that you make at least even and call it a day.
