bought my N810 at the Nokia store in New York last week, and it works fine. I don't know nothing about the ones being sold at Ebay....

I bought one N810 on ebay from an ebay seller. (with Paypal as an insurance) and it arrived with no issues at all. The only thing that was a bit of a disappointment was that the dutch customs did intercept the postal package and I had to pay extra import duties 
. Now it costs me about 400 euros. I expect it will still be cheaper than the initial price when it 'll be on sale in europe.
but all-in-all it was a good deal
