I wish i could remember the post which talked about the handset on the eForum. Hundreds of posts now will make it difficult to find.

Im waiting a few days before calling them myself. Getting enough ammo ready for a fight.

This is bizzarre, i've not had any text, letter or notification about this from VF and I use around 750mb a month on average so far!

I need to call them to ask about a much higher usage over the next billing period as I am away on tour for a few weeks with a band and will need access 24/7 to the net and very much doubt every venue will let us use the WiFi!

Dare I even ask about this charge? Or...Do I just claim ignorance as I've not had my 14 days notice?!

You: I have read on the vodafone forums that I will be charged £5 extra if I go over my 500Mb allowance

You: however, I have signed a contract woth vodafone which does not state any charges
Shailesh: Yes, that's correct
Shailesh: This will be effective from 1st of June 2010
You: additionally, vodafone have also failed to notify me regarding any changes to my terms and conditions
You: therefore I should be fully and legally entitled to cancel my contract with vodafone without incurring any additional early cancellation charges
Shailesh: Give me a minute
You: the Vodafone Terms and Conditions state: “7 Changing charges and terms a We may change our charges or introduce new charges. If we increase our charges, we will give you at least 14 days’ notice and you may have a right to end this agreement under clause 11. If we believe any change in our charges will not disadvantage you, we may include it without telling you. b We can make changes to or withdraw services at any time and we can make changes to or introduce new terms to this agreement at any time. We will give you at least 30 days’ notice of these changes if we do and you may have a right to end this agreement under clause 11.”
You: I have not received any notification whatsoever about the changes to my terms and conditions and my contract, as required by the Ofcom General Conditions (that Vodafone must observe at all times while operating as a service provider) state: “9.3 Where the Communications Provider intends to modify a condition in a contract with a Consumer which is likely to be of material detriment to the Consumer, the Communications Provider shall: (a) provide the Consumer with at least one month’s notice of its intention detailing the proposed modification; and (b) inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer.”
You: Therefore I have the legal right to reject the changes to my terms and conditions and cancel the contract without incurring any additional charges.

Shailesh: The fair usage policy for the Vodafone Mobile Internet (VMI) bundle is not in the terms and conditions of your agreement and we have given the required amount of notice for the change to take effect (14 days), this does not come into effect until the 1st June 2010.

You: This is not what I have been reading from the Vodafone forums, where administrators have been saying that it will kick in 1st June

You: So just because I have not gone over 500Mb yet, doesnt mean I wont in the future, and I should not be expected to pay penalty charges

Signed and reposted to facebook - I would recommend people doing the same.

I do not go over the usage as I mainly use wifi, however the way they are going about it is wrong.

also, can we check how much we used in unbilled usage so far??
I reset my data counter by mistake yesterday......

I've just been contacted by Vodafone via the phone.

They say that they cannot cancel my contract yet, until I can prove that the new charges directly affect me, even though all they have to do is look at my previous usage. Every month since I started my contract, i've been way over the 500mb limit.

Apparently all I have to do is wait for my next bill to come through, with the extra charges, then call them, and they will "review my contract".

Success!

this is not what I have been told

Given you are already reaching your allowance and in some cases are over, from June 1st, you will start to receive an alert to say you've gone over your allowance. We will be tracking your usage, and in the following months if your usage continues to be over your data allowance, we will contact you to discuss alternatives (including for example, upgrading to one of our mobile broadband plans) and that you could incur charges.



As you know we have a Fair Usage Policy and for the vast majority of customers, they do not use more than their data allowance. This Fair Usage Policy has always formed part of your price plan Terms and Conditions and due to this we are not in a position to allow you to cancel your contract without penalty
last month i did 260mb by mistake , and this month, i'm on nearly 4gb..

Well I've been on the phone to a manager at vodafone for 30 minutes and I finally convinced him that they've violated the contract. If you show them a time where you have gone over 500mb and not been charged, they will agree that the contract has changed. You can then cancel the contract if you want to.

if I cancel my contract do I have to return the phone ?? - I surely can't get to keep it !
