I would say: yes, as long as the "original equipment" manufactured is close enough to the N900's hardware that it doesn't require recompiling the proprietary parts - because the Hildon Foundation still doesn't have access to their source code, only redistribution rights for the binaries.
It will not be much of a problem, though. Create N900's clone which is waterproof, shockproof, dust-proof, and has inductive charging, and you will have at least some of the customers hooked. Manufacturing N900 exactly as it was would have likely been profitable; manufacturing N900 with improvements will be profitable for those who attempt it.
Just don't expect me to backup these claims with my own life. However much I believe them, my perception of space, time and world in general has been known to differ from reality.

Ooh boy. I remember a time when "buying rights, hardware designs and assembly line" for the Maemo series was a joke passed around on Maemo.org, a mere fantasy that we could only dream about.

Nowadays, with Nokia so in the gutter, it looks like a more sober proposition.
